Article 1 - Parties and transaction record
This Distance Service Agreement is concluded electronically between Mark Sigorta Aracılık Hizmetleri Anonim Şirketi (the "Company") and the Applicant identified in the immutable Transaction Summary.
The Company's legal and contact details are stated in the Preliminary Information and form part of this Agreement. The Transaction Summary identifies the traveler, selected service, processing option, dates, price items, currency, total amount and delivery method.
Article 2 - Formation of the agreement
The Agreement is formed when the Applicant, after having access to the Preliminary Information, Transaction Summary and contract documents, activates the separate contract-acceptance control and confirms the transaction electronically.
A privacy notice is not an acceptance document. A conditional personal-data consent, cross-border consent, commercial-communication choice and early-performance request are each separate declarations and are not inferred from contract acceptance.
Article 3 - Subject matter
The Company undertakes to perform the private visa application support service specified in the Transaction Summary with reasonable care and skill. The service may include information review, visible consistency checks, preparation, correction support, official-system submission support, Company-side tracking and document or result delivery.
The Company does not undertake to issue a visa, make an official decision, guarantee a decision time or secure admission to Türkiye.
Article 4 - Official portal and direct application
For Türkiye e-Visa, evisa.gov.tr is the official government portal. Eligible applicants may apply there directly without the Company. The Applicant confirms that the private and paid nature of the Company's service, its main characteristics and the official portal information were displayed before purchase.
Article 5 - Transaction Summary
The Transaction Summary is part of this Agreement. It must identify at least:
- the transaction and Applicant reference;
- the service and destination;
- the nationality and travel-document type used for the route assessment;
- the planned arrival date;
- the selected Company processing option and target window, if any;
- the start event and disclosed exceptions for that window;
- the Company service fee;
- the official or document fee, if any;
- the payment-processing charge, if any;
- the total amount and currency;
- the expected electronic delivery method;
- whether optional insurance is excluded or separately selected.
No hidden fee may be added after confirmation unless the Applicant expressly requests an additional service or a mandatory official amount changes before it is paid and the Applicant approves the revised summary.
Article 6 - Start and performance
Unless the Transaction Summary states a later time, the Company may start performance after contract formation, successful payment and receipt of the information and documents required for the selected service. In a consumer transaction where the statutory withdrawal period has not expired, an earlier start also requires the separate informed request and consent described in Article 7.
If correction, additional document, identity or payment verification is required, performance is suspended until the requirement is satisfied. The Company informs the Applicant through the supplied contact channel.
A target window applies only to the Company's service and starts at the event recorded in the Transaction Summary. Waiting for the Applicant, official system, bank or payment provider, and a stated force-majeure event, is treated according to the disclosed window rules.
Article 7 - Applicant's request for early performance
Where performance is requested before the statutory withdrawal period expires, the Applicant must make a separate, informed and express request and consent. The control must be empty by default and must not be hidden in the general contract checkbox.
Before that request is made, the Company must clearly state the consequence that mandatory law assigns to early or complete performance of the actual service. Early performance may limit or end the statutory withdrawal right only where the applicable legal conditions are met; a generic automatic-loss statement is not sufficient.
The declaration also explains that a later request may still be considered under the Company's contractual cancellation policy and that mandatory remedies for defective, late or non-performed service remain available.
If the Applicant does not request early performance, the Company does not begin the requested early work before the applicable withdrawal period expires unless another lawful start condition applies. If this makes the selected urgent option unavailable, the Applicant must be informed before payment and may select another option or abandon the transaction.
Article 8 - Right of withdrawal
A consumer may withdraw within the period granted by applicable distance-contract law, normally beginning on the date this service agreement is concluded, unless a lawful exception applies. Any longer or more favorable mandatory right remains reserved.
Where the Applicant has given the separate request and consent under Article 7 and performance has begun before that period expires, the service-start exception applies to the extent required by mandatory law and the statutory withdrawal right is no longer exercisable for that service.
The withdrawal notice may be sent through the cancellation/refund channel, the contact page, the registered address or another durable medium made available by the Company. The notice should include enough information to identify the transaction.
No reason or penalty is required for a valid statutory withdrawal. The Company may verify identity and authority to protect the transaction.
Article 9 - Financial consequences of valid statutory withdrawal
If the Applicant validly withdraws before performance begins, the Company refunds all payments received for that distance service within the period required by mandatory law, normally through the original payment method and without imposing any fee or additional obligation on the Applicant.
The Company must not transfer an official or third-party amount as part of performance before the permitted start event. Any mandatory rule more favorable to the Applicant remains reserved.
Article 10 - Contractual cancellation after performance begins
When a request is made after early performance has begun, the statutory withdrawal position is first determined under mandatory law and the exact transaction record. If a lawful exception applies, or to the extent the request falls outside statutory withdrawal, the Company also assesses contractual cancellation according to the stage of the service:
- before substantive review or preparation has been performed: the Company service fee is refundable;
- after review or preparation has begun: the refundable Company service fee may be reduced by the reasonable value of the service actually performed;
- after official submission support is completed or the result/document is delivered: the Company service fee is generally earned, subject to defective-performance remedies;
- an official or third-party amount is refundable only if it is recoverable from the recipient or mandatory law requires otherwise.
The Transaction Summary may define service stages more precisely. This contractual cancellation policy is not a waiver or replacement of mandatory rights relating to defective, late or non-performed service.
Article 11 - Refund method and timing
A valid statutory-withdrawal refund is made without undue delay and no later than the applicable statutory deadline, normally through the original payment method and without cost to the Applicant. A contractual or other refund is made within the period stated in the decision and any maximum period required by law.
For a contractual cancellation or another non-statutory refund, the Company may wait for confirmation that an official or third-party amount has been returned before refunding that specific item. The Company does not delay an undisputed refundable Company amount merely because a separate official amount remains under review.
Article 12 - Incorrect information and new applications
The Applicant is responsible for information supplied or approved. If an official submission or issued document contains Applicant-supplied incorrect information, a new application and new fees may be required. The Company is not obliged to finance an official re-application caused by the Applicant.
If the Company used information different from the final information confirmed in the Transaction Summary and this caused the error, the Company bears the reasonable cost of correcting its own service and provides the remedies required by law.
Article 13 - Official decision and force outside the Company
Official eligibility, approval, refusal, validity, permitted stay, number of entries and border admission are outside the Company's decision-making power. An adverse official result does not by itself mean the Company breached this Agreement.
The Company is not in breach for delay caused solely by an official-system outage, a payment-network failure, natural disaster, cyberattack, general communications failure, public-authority action or another event beyond reasonable control, provided it takes reasonable steps to limit the effect and informs the Applicant where practicable.
Article 14 - Delivery and inspection
The Company delivers the result or document by the method in the Transaction Summary. The Applicant must check the name, document number, dates and other visible information immediately and report any apparent discrepancy.
Failure to report an apparent error promptly may limit the practical ability to correct it before travel but does not remove a mandatory legal remedy.
Article 15 - Payment disputes and fraud
The Applicant should contact the Company before initiating a chargeback so the transaction can be reviewed. A chargeback is not a substitute for a valid cancellation notice and does not itself establish that a payment was unauthorized or refundable.
The Company may provide the bank or payment institution with the Transaction Summary, contract digest, acceptance evidence, service records, communications and delivery evidence. Suspected identity theft, document fraud or unauthorized payment may be reported to competent authorities.
Article 16 - Defective or non-performed service
The Company must perform the promised private service in conformity with this Agreement. Mandatory consumer remedies for a defective, late or non-performed Company service remain reserved and may include repeat performance, price reduction, termination or refund where the legal conditions are met.
An official refusal or border decision is not a defect in the Company service unless it was directly caused by the Company's proven breach.
Article 17 - Liability
The Company is liable for direct loss caused by its proven contractual breach, subject to mandatory law. It is not liable for loss caused by Applicant-supplied error, an Official Authority, an insurer, airline, bank or another event outside its reasonable control.
No clause excludes liability that cannot legally be excluded. Indirect or speculative losses are excluded only to the extent permitted by law.
Article 18 - Privacy and records
The Company processes personal data as described in the Visa Privacy Notice and applicable policies. It retains electronic evidence of the resolved contract text, locale, revision, Transaction Summary, confirmations, payment and performance events for the periods required by law and rights protection.
Article 19 - Complaints and dispute resolution
The Applicant may submit a complaint or request through visas.org.tr, the registered address or KEP. The Company reviews the record and provides a reasoned response where required.
Turkish law applies. Mandatory access to consumer arbitration committees, consumer courts and other competent remedies remains reserved.
Article 20 - Language and copies
The Applicant is given access to the Agreement and Transaction Summary on a durable medium. The Turkish and English versions are intended to have the same meaning. The Turkish version is used for interpretation to the extent permitted by mandatory law.
