Insurance Agency Service Terms

Insurance Agency Service Terms

Article 1 - Parties and transaction record

These Terms are concluded between Mark Sigorta Aracılık Hizmetleri Anonim Şirketi, Istanbul Trade Registry No. 348433-5, MERSIS No. 0612151602000001, Insurance Agency Registry No. T220706-6UJ6, at Üçevler Mahallesi 955. Sokak No: 1 D: 38, 34513 Esenyurt, Istanbul, Türkiye (the "Company" or "Agency"), and the person identified as the applicant or policyholder in the Transaction Summary.

The Transaction Summary displayed with these Terms identifies the applicant, policyholder, insured person, selected insurer and product, policy period, coverage option, premium, other price items, currency, payment method and delivery channel. It forms an integral part of these Terms.

Article 2 - Definitions

  • Applicant means the person who enters information or requests the transaction.
  • Policyholder means the person who concludes the insurance contract and is responsible for the premium as identified in the policy.
  • Insured means the person whose interest or risk is covered under the policy.
  • Insurer means the licensed insurance company identified in the Transaction Summary and policy and responsible for coverage, underwriting and claims.
  • Policy Documents means the policy, insurer information form, special conditions, general conditions, coverage and exclusion schedule and any endorsement.
  • Agency Service means the application, quote coordination, premium collection, policy-issuance intermediation, delivery, tracking and administrative support expressly described in these Terms.

The Applicant, Policyholder and Insured may be the same or different persons.

Article 3 - Legal status and allocation of responsibility

The Company acts as an insurance agency within the scope of authority granted by the selected Insurer. It is not the Insurer and does not itself assume the insured risk.

The insurance contract is formed with the Insurer identified in the Policy Documents. The Insurer determines underwriting, final premium, coverage, exclusions, policy issuance, assistance, claim acceptance, indemnity calculation and payment. The Company performs only the Agency Service within its authority.

These Terms do not replace the Policy Documents. For coverage, exclusions, limits, waiting periods, territorial scope, claim duties and indemnity, the Policy Documents and mandatory law prevail. For the Company's separate Agency Service, these Terms apply.

Article 4 - Scope of Agency Service

Depending on the selected product and available infrastructure, the Company may:

  • receive and organize application information;
  • perform format, completeness and apparent consistency checks;
  • obtain or display a quote under configured Insurer rules;
  • transmit necessary data to the selected Insurer;
  • present pre-contractual information and Policy Documents;
  • collect the premium or disclosed amount within its authority;
  • carry out authorized policy-issuance steps;
  • retrieve and electronically deliver the issued policy;
  • provide Company-side application and policy status information;
  • receive correction, endorsement, cancellation or refund requests and route them appropriately;
  • provide administrative guidance to the Insurer's claim or assistance channels.

The Company does not provide medical diagnosis, treatment, emergency response or a claim guarantee.

Article 5 - Applicant authority and truthful disclosure

A person acting for another individual confirms lawful authority to apply, provide data and documents, make payment and receive the policy on that person's behalf. The Company may request proof of identity, parental responsibility, guardianship or authority.

The Applicant and Policyholder must provide complete, accurate, current and non-misleading information and must answer material questions truthfully. Particular care must be given to name, date of birth, nationality, passport or identity details, travel dates, destination, policy period, persons insured and any declaration requested for the product.

A Company consistency check is not authentication and does not transfer the duty of disclosure. Incorrect or incomplete information may lead to re-pricing, refusal to issue, endorsement, cancellation, invalidity, reduction or refusal of a claim, rejection by an official authority or another consequence permitted by law and Policy Documents.

Article 6 - Quote and pre-contractual information

A displayed quote is based on the information entered, the selected Insurer's current tariff and acceptance rules and the period for which the quote remains valid. It is not a policy and does not create coverage.

Before final confirmation, the Applicant must be able to review:

  • the selected Insurer and product;
  • the essential coverage and exclusion summary;
  • policy inception and expiry dates;
  • premium, taxes and other disclosed price items;
  • payment and delivery method;
  • cancellation, withdrawal and refund information;
  • the Insurer information form and available Policy Documents;
  • these Terms, the Insurance Pre-Contractual Information and the Distance Financial Services Agreement.

The Applicant must correct any inconsistency before confirmation.

Article 7 - Premium and payment

The total amount is the amount shown in the Transaction Summary. It may include the insurance premium and only those additional payment items separately identified before confirmation.

Payment may be processed through a bank, payment institution or secure card infrastructure. A payment authorization may be subject to 3-D Secure, fraud screening or additional verification. Full card numbers and security codes are not stored in the Company's application database.

A successful payment does not by itself create coverage. If payment succeeds but the policy cannot be issued, the transaction is investigated and the premium or other refundable amount is corrected or returned in accordance with the applicable records and law.

Article 8 - Policy issuance and commencement of coverage

A policy is issued only if the application satisfies the selected Insurer's acceptance rules, required information and payment conditions and the Insurer system creates a valid policy record.

Coverage begins only in accordance with the Policy Documents, normally after the policy has been validly issued, the required premium condition has been met and the policy inception date and time have arrived. The Transaction Summary or payment confirmation alone is not proof that coverage has started.

If the Insurer declines the application or materially changes the offer, no different product or premium is imposed without the Applicant's confirmation where confirmation is required.

Article 9 - Delivery and duty to check

The issued policy may be delivered through the email address, secure link, status page or other durable medium identified in the Transaction Summary.

Immediately after delivery, the Policyholder and Insured must check the Insurer, product, names, identity or passport details, policy number, inception and expiry, territorial scope, coverage limits, exclusions, special conditions and premium. An apparent error must be reported without delay.

Failure to report an apparent error before travel or before the relevant risk occurs may limit the practical possibility of correction, without removing mandatory rights.

Article 10 - Corrections and endorsements

A requested correction after issuance is subject to the Insurer's rules, underwriting approval, policy status and applicable law. The Insurer may require an endorsement, additional premium, cancellation and re-issuance, or may refuse a change that would alter an already materialized risk.

Where an error resulted solely from the Company using information different from the final Transaction Summary, the Company will take reasonable steps within its authority to correct the Agency Service. Where the error results from information supplied or approved by the Applicant, related additional premium, new policy or third-party cost may be payable by the Applicant.

Article 11 - Cancellation, withdrawal and refund

Statutory withdrawal rights and product-specific cancellation rights are explained in the Insurance Pre-Contractual Information, Distance Financial Services Agreement, Transaction Summary and Policy Documents.

A request is assessed according to the applicable right, policy issue status, inception date, period already on risk, claim or assistance use, Insurer rules and mandatory law. Not using a policy does not automatically create a refund right.

If a premium refund is due, the amount may be calculated by the Insurer under the Policy Documents and law. A payment-processing amount already lawfully and irreversibly charged by a third party is treated only as disclosed and permitted by law. Duplicate or erroneous collection is corrected after verification.

Article 12 - Use for visa, entry or residence purposes

A travel or health insurance policy may be requested for a visa, entry, residence or another official procedure. The Policyholder is responsible for selecting a product and period appropriate to the intended purpose and for checking the current requirements of the competent authority.

The Company does not guarantee that an authority, consulate, border officer or other institution will accept the policy. Policy issuance does not guarantee a visa, residence right, boarding or entry into Türkiye.

Article 13 - Claims and assistance

A claim, medical need or assistance request must be reported through the Insurer or assistance contact shown in the Policy Documents and within the required time and method. The Insured must provide requested records truthfully and take reasonable steps required by the policy.

The Company may help identify the correct channel and transmit administrative information, but the Insurer decides coverage, document sufficiency, medical or assistance authorization, indemnity and payment. The Company does not pay claim compensation.

In an emergency, the person must contact the relevant emergency service and the Insurer or assistance provider as directed in the policy. The website is not an emergency-response service.

Article 14 - Security and misuse

The Company may verify identity, authority, application consistency and payment status and may pause a transaction where there is suspected fraud, unauthorized card use, falsified document, duplicate application, sanctions concern or technical misuse.

Additional verification may be requested. If verification is not completed, the transaction may not proceed. Where required or permitted, suspicious conduct may be reported to the Insurer, payment provider or competent authority.

Article 15 - Communications

Service communications may be sent to the contact information provided by the Applicant, including policy delivery, missing information, payment, correction, cancellation and security notices. The Applicant must keep contact details accurate and monitor spam or junk folders and status links.

Marketing communication is separate, optional and never a condition of insurance. Withdrawing a marketing preference does not stop necessary policy or security communications.

Article 16 - Personal data

The Company processes personal data as explained in the Insurance Application Privacy Notice and general Privacy Policy. The selected Insurer may be a separate data controller under its own notice. A general contract acceptance is not an explicit consent for special-category processing or international transfer.

Article 17 - Intellectual property and lawful use

The platform, text, interface, software, brand and content may be used only for the intended lawful transaction. Automated extraction, interference, malicious code, false application, impersonation, unauthorized use of another person's information or abuse of secure links is prohibited.

Article 18 - Liability

The Company is responsible for direct loss caused by its proven breach of the Agency Service to the extent required by mandatory law. It is not responsible for an Insurer's independent underwriting or claim decision, an authority's decision, the Applicant's inaccurate information, an undisclosed condition, a bank or network failure, or an event outside the Company's reasonable control.

Nothing excludes liability that cannot lawfully be excluded, including mandatory consumer rights. Indirect, speculative or consequential losses are excluded only to the extent permitted by law.

Article 19 - Force majeure and third-party systems

Service may be delayed by Insurer-system outage, payment-network failure, cyberattack, communication interruption, public-authority action, natural disaster or another event beyond reasonable control. The Company will take reasonable steps to limit the effect and communicate material delay where possible.

Article 20 - Complaints and disputes

A complaint about the Agency Service may be submitted through visas.org.tr, to the registered address or by KEP. A complaint about coverage, claim or indemnity may also need to be directed to the selected Insurer using the channel stated in the Policy Documents.

Rights to apply to competent consumer bodies, courts, insurance arbitration or other authorized mechanisms under applicable law are reserved. Turkish law applies, without limiting mandatory protections that cannot be waived.

Article 21 - Acceptance, evidence and language

Before final confirmation, the Applicant is shown these Terms together with the Insurance Pre-Contractual Information, Distance Financial Services Agreement and Transaction Summary. The combined contract checkbox records acceptance of the contractual documents separately by revision and digest. A privacy notice is not included as consent.

The final resolved documents, locale, revision, Transaction Summary, confirmation time and technical evidence may be retained on a durable medium. Turkish and English versions are intended to carry the same meaning. To the extent permitted by mandatory law, the Turkish version prevails in interpretation.
