Insurance Pre-Contractual Information

Insurance Pre-Contractual Information

This document must be displayed before the Applicant gives the final contractual confirmation. It must be read together with the live Transaction Summary, the selected Insurer's information form, coverage and exclusion summary, general and special conditions, Insurance Agency Service Terms and Distance Financial Services Agreement.

1. Agency and contact information

The insurance agency is Mark Sigorta Aracılık Hizmetleri Anonim Şirketi.

  • Istanbul Trade Registry number: 348433-5
  • MERSIS number: 0612151602000001
  • Tax office and number: Esenyurt / 6121516020
  • Insurance Agency Registry number: T220706-6UJ6
  • Address: Üçevler Mahallesi 955. Sokak No: 1 D: 38, 34513 Esenyurt, Istanbul, Türkiye
  • KEP: [email protected]
  • Website: visas.org.tr

The Company acts as an insurance agency within its authority. It does not itself provide insurance coverage or pay claim compensation.

1.1 How the agency operates

The Company is authorised to act as an insurance agency under the Insurance Agency Registry number stated above. The insurance company whose product is offered is identified in the quotation, in the Transaction Summary and in the policy before the Applicant is bound.

Where the Company is authorised to place business with more than one insurance company, the offer presented for a given product may come from a single one of them. The offer is not presented as the result of a comparison of the market, and the Company does not state that no better product exists elsewhere.

The Company offers the product through intermediation. It does not give a personal recommendation, does not provide an advice service based on a fair analysis of the market and does not assess whether the product suits the Applicant's individual circumstances. The Applicant remains responsible for checking that the product and the policy period match the intended purpose.

1.2 How the agency is remunerated

The Applicant pays the premium and any additional price item shown in the Transaction Summary. No separate agency fee is added to that total unless it is displayed in the Transaction Summary as its own line item before final confirmation.

Any remuneration the Company receives from the insurance company for placing the business is paid out of the premium and does not increase the amount payable by the Applicant.

On a request made before the contract is concluded, the Company states the nature of its remuneration for that transaction. A request may be sent through the contact page, the registered address or KEP.

2. Insurer, product and persons covered

The Transaction Summary displayed with this document must identify, without an unresolved placeholder:

  • the licensed Insurer providing the coverage;
  • the exact product and, where applicable, plan or additional coverage;
  • the Policyholder and each Insured person;
  • the insured risk or travel purpose;
  • the policy inception and expiry date and time;
  • the territorial scope;
  • the currency, premium and every additional price item;
  • the quote-validity deadline;
  • the policy-delivery method.

No final confirmation may be taken while the Insurer, product, policy period or total price is unknown.

3. Essential characteristics of the insurance

The essential characteristics are the characteristics stated in the Transaction Summary and the selected Insurer's documents. The Applicant must review at least:

  • principal coverage and coverage limits;
  • territorial and time limits;
  • persons and risks covered;
  • exclusions, waiting periods and special limitations;
  • deductibles, co-payments or sub-limits where applicable;
  • duties before and after a loss;
  • assistance and claim-notification channels;
  • renewal status, if any;
  • cancellation, withdrawal and refund rules.

A website summary is not a substitute for the final policy, special conditions and general conditions. The Policy Documents govern the insurance coverage.

4. Suitability and no official-acceptance guarantee

The Applicant is responsible for checking that the product and policy period match the intended travel, visa, entry, residence or other purpose. The Company may provide general guidance but does not provide a guarantee that an official authority will accept the policy.

The issuance of a policy does not guarantee a visa, residence permit, boarding, entry into Türkiye, claim acceptance or indemnity payment.

5. Information and disclosure duty

The quote and policy are based on information supplied or approved by the Applicant. Names, dates of birth, nationality, passport or identity details, destination, travel dates, policy period, insured persons and all material declarations must be complete, accurate and current.

Incorrect or incomplete information may affect pricing, policy validity, coverage, an official procedure or a claim. The selected Insurer may exercise rights available under the policy and law. The Company's apparent-consistency review does not replace the Applicant's disclosure duty.

6. Price, premium and payment

The Transaction Summary must show the total price before confirmation and separately identify the insurance premium and any additional amount. No undisclosed optional amount may be added.

Payment is made using the method shown in the transaction. A bank or payment institution may carry out authentication, 3-D Secure or fraud checks. A successful card authorization is not in itself proof of policy issuance or commencement of coverage.

7. Formation, policy issuance and coverage start

The insurance contract is formed with the selected Insurer when the conditions shown in the transaction and Policy Documents are fulfilled and the Insurer creates the valid policy record. The Company performs the authorized agency steps.

Coverage starts only under the Policy Documents, generally after valid issuance, satisfaction of the required premium condition and arrival of the policy inception date and time. The Applicant must not rely on the payment screen alone.

If the application cannot be accepted or the final offer differs materially, the Applicant is informed. A changed product, period, coverage or premium is not imposed without confirmation where legally required.

8. Contract duration and termination

The policy duration is the period shown in the Transaction Summary and policy. A fixed-term travel policy normally ends at its stated expiry without automatic renewal unless the transaction expressly says otherwise.

Cancellation, termination, endorsement or non-renewal after formation is governed by mandatory law and the Policy Documents. A termination request must not be required through a method more burdensome than the method used to form the contract.

9. Withdrawal right

Unless a mandatory product-specific rule or exception applies, a consumer may withdraw from a distance financial services contract within 14 days without giving a reason or paying a penalty. The period starts on the date the contract is formed; if all contract terms are delivered on paper or another durable medium later, it starts when those terms are received. More favorable insurance-specific rights remain applicable.

A withdrawal notice sent within the period in writing or by durable medium is sufficient. The Applicant may use the cancellation/refund request surface, the registered address or KEP. An online request must receive an immediate receipt confirmation.

The Transaction Summary must explicitly state whether the right is available, its start and end date and the method of exercise. In particular, subject to consumer-favorable rules in other legislation, the distance-financial-services withdrawal right may not be available for:

  • travel, baggage or similar short-term insurance with a validity of less than one month;
  • a contract fully performed by both parties at the consumer's explicit request before withdrawal is exercised;
  • another case expressly excluded by mandatory law.

10. Performance during the withdrawal period

If the consumer asks for the policy or Agency Service to begin during the withdrawal period, the request must be given separately and expressly. Where withdrawal is later exercised, the consumer may be responsible only for a proportionate amount corresponding to the service actually performed and for lawful public or third-party costs, provided the required pre-contract information was given.

If the contract is fully performed before withdrawal upon the consumer's explicit request, the right may cease where the law permits. Defective performance rights remain unaffected.

11. Consequences and refund

On a valid withdrawal, the relevant parties carry out refund and return obligations within the statutory periods. Under the general distance-financial-services framework, the provider returns amounts other than lawfully chargeable performed-service and third-party items within thirty days; any more favorable insurance-specific period applies.

The consumer must return any amount due for proportionate service or lawful cost within the applicable period. No amount may exceed the proportion of the agreed service actually performed or operate as a penalty.

Outside statutory withdrawal, cancellation and premium refund are calculated under the Policy Documents, period on risk, claim or assistance use and mandatory law. Simply not using the policy does not guarantee a refund.

12. Claims and assistance

A claim or assistance request must be notified using the Insurer or assistance contact in the Policy Documents and within the stated period. Coverage, medical authorization, document sufficiency, indemnity and payment are decided by the Insurer. The Company may provide administrative guidance but does not decide or pay the claim.

The website is not an emergency service. In an emergency, contact the competent emergency service and the Insurer or assistance provider.

13. Delivery and durable medium

The policy, information form, contract terms and Transaction Summary are delivered or made available in a form that can be stored and reproduced unchanged for an appropriate period. The Policyholder may request a paper copy of the distance financial services contract during the relationship without a contractual charge where the law provides that right.

The Applicant must download or save the final documents and immediately check all details.

14. Personal data

The Company processes data under the Insurance Application Privacy Notice. The selected Insurer may be a separate data controller. A notice is not consent, and the contractual checkbox does not serve as consent for optional marketing, health-data processing or international transfer.

15. Complaints and legal remedies

Agency-service complaints may be submitted to the Company through visas.org.tr, its registered address or KEP. Coverage and claim complaints may also need to be submitted to the Insurer.

The rights to apply to the competent consumer arbitration committee, mandatory mediation where applicable, consumer court, insurance arbitration and other authorized mechanisms are reserved. The exact forum depends on the subject and applicable law.

16. Confirmation checklist

Before confirming, the Applicant must verify that the screen shows and correctly records:

  • the Insurer and exact product;
  • every person insured;
  • the policy period and territorial scope;
  • the coverage and major exclusions;
  • premium, currency and total price;
  • whether a withdrawal right applies and any short-term-policy exception;
  • whether early commencement is requested;
  • the delivery and claim channels.

The transaction must remain unavailable if a mandatory item above is missing.
