Article 1 - Parties
This Agreement records the distance method by which the insurance transaction and the Company's Agency Service are concluded.
Agency / intermediary: Mark Sigorta Aracılık Hizmetleri Anonim Şirketi, Istanbul Trade Registry No. 348433-5, MERSIS No. 0612151602000001, Insurance Agency Registry No. T220706-6UJ6, Üçevler Mahallesi 955. Sokak No: 1 D: 38, 34513 Esenyurt, Istanbul, Türkiye. KEP: [email protected].
Policyholder / consumer: The person identified in the Transaction Summary.
Insurer: The licensed insurance company identified in the Transaction Summary and Policy Documents. The Insurer provides coverage and is the insurance-contract party; the Company acts within its agency authority.
Article 2 - Integral documents
The following resolved records form one transaction file:
- the Transaction Summary;
- the Insurance Pre-Contractual Information;
- the Insurance Agency Service Terms;
- this Agreement;
- the selected Insurer's information form;
- the coverage and exclusion summary;
- the policy, special conditions, general conditions and endorsements when issued;
- any separate early-commencement request.
A privacy notice and an optional consent are not contractual acceptance documents.
Article 3 - Distance method and formation
The parties act without being physically present together, using the website, secure links, electronic confirmation and payment infrastructure.
The Policyholder's confirmation is recorded electronically. The insurance contract is formed with the selected Insurer when the Insurer's acceptance and payment requirements are satisfied and a valid policy is issued. The Agency Service contract is formed when the Policyholder confirms the contractual set and the Company accepts the transaction for processing.
No contract is formed for an unresolved Insurer, product, policy period or price.
Article 4 - Subject and service
The subject is the distance arrangement of:
- the selected insurance coverage to be provided by the Insurer; and
- the Company's Agency Service for intake, quote and policy coordination, authorized premium collection, policy delivery, status and administrative support.
The exact coverage is not created by this Agreement alone. It is determined by the issued Policy Documents.
Article 5 - Transaction-specific terms
The Transaction Summary states the Policyholder and Insured persons, Insurer, product, policy period, territorial scope, principal coverage selection, premium, additional price items, currency, payment method, delivery channel, quote validity and whether a statutory withdrawal right or short-term-policy exception applies.
The Policyholder confirms that these terms have been reviewed before final confirmation.
Article 6 - Price and payment
The Policyholder pays the total amount shown in the Transaction Summary. Any insurance premium and additional amount must be separately identified. No hidden or preselected optional charge is binding.
Payment may be subject to bank or payment-provider authentication. Payment authorization alone is not policy issuance. If policy issuance fails after collection, the parties reconcile and refund or correct the amount in accordance with the records and law.
Article 7 - Performance and coverage
The Company begins the Agency Service at the time recorded in the transaction. The Insurer issues the policy only if its requirements are met.
Insurance coverage begins at the date and time and under the conditions stated in the Policy Documents. It does not begin solely because this Agreement was accepted or payment was authorized.
Article 8 - Delivery and records
Before confirmation, the pre-contractual information and contract terms are provided in a clear and readable form. The final contractual documents and Policy Documents are delivered on paper or another durable medium that allows storage and unchanged reproduction.
The Company retains the resolved documents, revision, locale, Transaction Summary, acceptance evidence, payment and delivery events in accordance with law and the Privacy Notice. The Policyholder may request a paper copy of this Agreement during the contract relationship without a contractual charge where required by law.
Article 9 - Withdrawal period
Unless a mandatory product-specific provision or an exception applies, a consumer may withdraw within 14 days without reason or penalty. The period begins when the contract is formed. If the complete contractual terms are received on paper or another durable medium later, the period begins on that later receipt date. More favorable insurance-specific rules apply.
The Transaction Summary records the applicable period and end date. The Agency must be able to prove that the information was given.
Article 10 - Exercise of withdrawal
A clear withdrawal declaration must be directed within the period in writing or by durable medium. The Policyholder may use the website's cancellation/refund request function, the registered address or KEP. Use of a fixed form is optional; an unambiguous statement is sufficient.
Where withdrawal is submitted online, the Company sends an immediate acknowledgement. The Policyholder cannot be required to use a method more burdensome than the distance method by which the contract was formed.
Article 11 - Exceptions
Subject to any more favorable consumer rule in insurance legislation, the distance-financial-services withdrawal right does not apply to:
- travel, baggage or similar short-term insurance with a validity of less than one month;
- a contract fully performed by both parties, upon the consumer's explicit request, before the consumer exercises withdrawal;
- another case expressly excluded by mandatory law.
An exception must be identified in the Transaction Summary before confirmation. A generic statement cannot be used to remove a right that applies to the selected policy.
Article 12 - Early commencement
If the Policyholder wants the policy or service to commence before the withdrawal period expires, a separate, empty-by-default request is required. The request must identify the intended inception date and explain the consequences.
Where withdrawal remains available and is exercised after performance starts, the Policyholder may be required to pay only:
- the proportionate price for the service actually performed up to notice; and
- lawful public or third-party costs already paid,
provided the calculation method was disclosed. The amount cannot exceed the performed proportion or operate as a penalty.
Where the contract has been fully performed by both parties before withdrawal upon explicit request, the right may be unavailable under the applicable exception. Rights arising from defective or non-performance remain.
Article 13 - Refund and reciprocal obligations
On valid withdrawal, the provider returns all amounts other than lawfully payable performed-service and third-party items within the statutory period and by a payment method consistent with the original transaction, without imposing an additional charge. Under the general distance-financial-services rule, this period is thirty days; a more favorable insurance-specific period applies.
The Policyholder returns any proportionate performed-service amount and lawful cost due under the applicable rule within the statutory period. The withdrawal also ends a linked ancillary contract without penalty where mandatory law so provides, and the relevant third party is notified.
Article 14 - Cancellation after withdrawal period
After the statutory withdrawal period, cancellation, termination, endorsement and premium refund are governed by mandatory law and the Policy Documents. The calculation may depend on time on risk, claim or assistance use and the selected Insurer's rules.
The Policyholder may submit termination through any remote communication method made available by the Agency or Insurer and cannot be forced to use a more burdensome method than the one used to form the contract.
Article 15 - Policyholder obligations
The Policyholder must:
- provide truthful and complete information;
- review the Insurer, product, coverage, exclusions, period and price;
- keep payment and contact details accurate;
- check the issued policy immediately;
- report an apparent error without delay;
- comply with premium, prevention, notification and document duties in the Policy Documents;
- avoid unauthorized use of another person's identity, data or payment method.
Article 16 - Claims and insurer responsibility
The Insurer is responsible for underwriting, coverage, assistance, claim and indemnity decisions. The Company may provide administrative guidance but cannot bind the Insurer outside its authority and does not pay indemnity.
The Policyholder and Insured must use the claim and emergency channels shown in the Policy Documents.
Article 17 - Complaints and remedies
Agency complaints may be submitted through visas.org.tr, the registered address or KEP. Coverage or claim complaints may need to be addressed to the Insurer.
The consumer may apply, according to the subject and thresholds, to the competent consumer arbitration committee, mandatory mediation, consumer court, insurance arbitration or another authorized mechanism. Mandatory rights are reserved.
Article 18 - Governing law, language and evidence
Turkish law applies. Mandatory consumer protections cannot be waived. Electronic records, resolved documents, transaction digest, timestamps, payment and delivery records may constitute evidence subject to applicable procedural rules.
Turkish and English versions are intended to have the same meaning. To the extent permitted by mandatory law, the Turkish version prevails in interpretation.
